DELL VISTA INSTANT WIN GAME

Rules and Regulations for – www.experiencedell.com

1. Residents of Canada who have reached the age of 13 or older at the time of entry may enter, except employees (or their immediate family) of Dell Canada Inc. (“Dell”), Launchfire Interactive Inc. (“Launchfire”), or Microsoft Corporation (“Microsoft ”) and their affiliates and advertising and promotional agencies and persons with whom they are domiciled.

2. No purchase necessary to enter. Contest commences on November 19, 2007 at 12:00 p.m. EST and closes on January 21, 2008 at 16:59 p.m. EST (the “Contest Period”).

3. To enter, go to www.experiencedell.com (the “Site”) and locate the “Enter Contest” or “Sign Up” links.  Click on the “Register” link and enter name, province of residence, telephone number, email address, username and password and click “Submit”. This entitles the user to two opportunities to play the Dell Vista Instant Win Game (each a “Game Play”). 

The entrants can earn additional Game Plays by:

a) Returning to the Site daily and logging in (1 extra Game Play per day to a maximum of 64 Game Plays);

b) Going to the Site and completing a Microsoft Vista Interactive Demonstration (“Demo”). The entrants can receive a maximum of 19 Game Plays per Demo. There will be 3 Demos total. The first time the entrant completes a Demo they earn 3 Game Plays. Upon completing it a second time the entrant will earn 6 additional Game Plays. Upon completing it a third time the entrant will earn 10 more Game Plays, for a total of 19;

c) Opting-in to the Dell e-mail (5 additional Game Plays);

d) Opting-in to Dell SMS (5 additional Game Plays);

e) Opting-in to the Microsoft e-mail (5 additional Game Plays);

f) 1 Game Play for each of the first ten emails sent using “Invite A Friend”;

g) 1 Game Play for each of the first ten recipients who visit the Site as a result of using “Invite a Friend Email”;

h) 3 Game Plays for each of the first ten recipients who register for the Site as a result of using “Invite a Friend Email”;

i) The entrant will receive 5 extra Game Plays to win for directing third parties to the Site via your personal web link (up to 50 Game Plays). To retrieve personal web link, entrant shall click on the “Invite a Friend” link and locate the personal web link or personal banner on this page. The distribution of entrant’s personal web link is at entrant’s discretion, subject to the following: Dell reserves the right to cancel and void any Personal Link and all associated entries which it deems, in its sole discretion to be used or associated with content which is deemed inappropriate. Without limiting the foregoing, such content includes all forms of pornography, inappropriate language and content that incites hate, is demeaning, depreciates the value of the Dell name, brand, products or trademarks, or incites discrimination of any and all forms. By way of example, an entrant may wish to post his/her link on instant messenger, blogs, message boards and personal web pages or in emails.

The total number of possible Game Plays for each entrant is 238: Registration (2); Daily Visit (64); Invite a Friend (50); Post a Link (50); Email Communication Opt-in (10); Wireless Alerts (5); and Completing Demos (57)

4. In total 109 instant win Prizes will be awarded. Total estimate value of the Prizes is $ 9533.97.  

5. The aforementioned Prizes will be awarded as follows:

a) Go to the Site and play the Dell Vista Instant Win Game. If the entrant clicks on 3 consecutive matching icons, they become eligible to win a randomly allocated Prize. There will be a total of one hundred and nine (109) random, computer-generated winning games during the Contest Period. Upon receiving a winning message the entrant will be issued a verification code.

b) ALL POTENTIAL WINNING GAME WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE INSTANT WIN GAME SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING VERIFICATION CODE HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY, IS VOID, AND WILL NOT BE HONORED

All selected potential game winners must comply with all terms and conditions of these rules and regulations, and winning is contingent upon fulfilling all requirements. Administrator is an independent judging organization whose decisions as to the administration and operation of the Dell Vista Instant Win Game and the selection of potential winners are final and binding in all matters related to the Dell Vista Instant Win Game.

c) Chances of winning a Prize depend on the number of eligible Game Plays received during the Contest Period. Prizes must be accepted as awarded.  Dell reserves the right to substitute Prizes of approximately equal value for the Prizes listed above and reserves the right to terminate or withdraw this contest at any time, without prior notice.

7. All entries shall become the property of Dell.  Dell is not responsible for (i) lost, misdirected, delayed, destroyed, illegible, incomplete or otherwise improperly completed entries or (ii) the loss, theft or misuse of any Prize.  Dell is not responsible for any problems resulting from mechanical error, including, but not limited to, Prizes awarded or not awarded due to computer error or failed network connection, however caused.  Any attempt to deliberately damage any website or to undermine the legitimate operation of the promotion is a violation of criminal and civil laws and should such an attempt be made, Dell reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if illegible, mechanically reproduced, forged, falsified, altered or tampered with in any way.

8. Winners will be required to sign a declaration and release form confirming acceptance of the Prize as awarded and releasing Dell and its affiliates from any liability relating to their Prize.  By entering this contest, entrants consent to the use of their names, photographs and/or likeness for publicity purposes in connection with this contest without further compensation.  In the event that the winner is under the age of majority in their province of residence, their parent or legal guardian will be required to sign the declaration and release on their behalf.

9. Residents of Quebec: Any litigation concerning the conduct or administration of the Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation concerning the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
